How could the Napster trial have been prevented?

Just curious what Napster could have done different. The business was a pioneer in file sharing, but what should they have done in order to be legit.

1) They almost made some legit deals but they hired this inexperienced, too pushy lady director person. I don't remember her name, but if you read their stories they say she was their main downfall.
