Has anyone had the wrong home insurance policy wrote up from allstate?
We purchased a home and had allstate insurance, we recently had a fire and now we are being told that we had the wrong policy and we are in a long drawn out process. We dont know if the policy will be covered or not yet. Allstate is dragging there feet. Even though it is the agents responsibility to take pics and view the home she did not. they told us that the agents are not actual employees of allstate. can anyone give us advice on what to do? We have a single wide trailer with a living room extension and a sunroom extension. The agent was told all the details of the home. She never took pics of the home and never had us sign the policy, however we have been paying them for 5 months now. They have had plenty of time to not insure the house if they wanted. Arson was never a question, it was an electrical fire, my family was in the home the time of the fire.1) It sounds like she wrote a homeowners policy instead of a mobilehome policy. If she saw the home and still wrote a homeowners policy & it comes out that Allstate will not cover the fire because of it, it sounds like you may have an errors & ommissions case against the agent. You didn't sign an application? That doesn't sound right either.
2) Advice--- start looking for another place to live..That is why I did not buy a mobile home... After an age cannot buy insurance. After 20 years cannot get a mortage or home owners insurance.. Sorry -- Best of Luck...
3) Ah, she wrote a standard homeowners instead of a trailer policy. But you never SIGNED anything? Did you get a BILL that you paid your monthly payments on? If you have a BILL, then they issued a POLICY, and you have a policy number SOMEWHERE, and eventually, one way or the other, you're probably going to see some money. If there's no BILL, no POLICY number, you're going to have to sue her for errors and ommissions - so go dig out copies of the cancelled checks. Meanwhile, this is likely to take a while - so procede as if you had no insurance for now. And start interviewing lawyers.
4) It does sound as if your agent sold you a homeowners policy instead of a mobile home policy. Depending on the state where you policy was issued the company (in this case Allstate) had a specific amount of time to cancel the policy usually anywhere from 30, 45 or 60 days. The onus was on them to inspect and take pictures (whether they do this through their agent or their own company inspectors) and do whatever underwriting was necessary. Unless they can prove that you withheld information they will have to honor the policy. I concur that you need to seek the counsel of an attorney as soon as possible. You will probably have to file suit against both the insurance company and the agent and don't forget to also file a complaint with the insurance commissioner. Good Luck
5) Send a letter to the State Insurance Commission and a copy to Allstate. You will see a miraculous turn a round. They don't want to be investigated which is what will happen based on your complaint to the State in which you live.
