An Allstate insurance customer hit my car. Do I have to accept their offer to repair it with used parts? Please don't answer this if you don't know anything and are just trying to score easy points. Also, it's a 1989 Celica, WAS in good condition. I got an estimate for $3089 from a shop. Allstate is offering $1220. They sent a second adjust out and this increased it from their original quote of $1069. He said "Don't worry about the "number", it doesn't matter." But if it's this near to being totalled, I want it totalled rather than drive and later try to sell, a vehicle that has been wrecked (while it was parked). Oh yes, and I didn't have full coverage, so I can't run it through my insurance company.1) uh....no. Dood if they hit you, you get whatever parts you want
2) No, you can call their claims agent and say that if they don't replace them with new ones you will sue them. Or, tell them that your neck is hurting and that if they don't give you new parts you will make a medical claim against them as well. This works, my DH did it when some jerk hole truck driver dumped gravel on his car as he was going down the road.

5) No you do not have to accept it. You have the right to be made whole, which means your car was not made with used parts, and you do not have to accept a car repair like that. Just for your information: I had someone's insurance who fixed my car like that, and I didn't know it. The paint does not stay on the used parts that are used. Fight tooth and nail and tell them he11 no. You have the right to get it fixed where you want how you want.

7) Absolutely not, you do not have to follow THEIR insurance policy's rules. Talk to your agent as soon as possible.
8) no you don't. but if you cash any checks you have no recourse. have an attorney write a letter. it may cost you a few bucks if you don't know one but well worth it. however, if your car is hard to get parts for, you may not have a choice.
9) Dude if its not your fault....you can take your car anywhere you want....within reason Remember it's not your fault....beside let your insurance talk to their insurance that way you don't get involved....thats why you pay
10) I don't know what state you are in but usually the insurance company will ask you to send them 2 or 3 quotes as to how much the repairs will be and they'll offer to pay you as much as the cheapest one. I believe you can ask that they use new parts but I can't honestly say if all states let you request them. i live in Virginia and they do allow you to request new parts.
11) I personally have State Farm insurance and they use "used" parts. But, the parts have to be accepted by the body shop. Mine rejected part after part. If no suitable part can be found they have to use new. I think more importantly than what insurance company's car hit you, is what insurance you have, and what body shop you use. Good luck!
